These Terms and Conditions set out the basis on which Rubbish Removal Brompton provides rubbish clearance and waste collection services. 1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Service means any rubbish removal, waste collection, clearance, loading, transport, disposal or related work carried out by Rubbish Removal Brompton.

Customer means the individual, business, landlord, tenant or other party who makes a booking with Rubbish Removal Brompton or in whose name the booking is made.

Waste means any items, materials or substances that the Customer asks us to remove, including household rubbish, commercial waste, garden waste, bulky items and similar materials, excluding prohibited items as set out in these terms.

Operatives means any staff, contractors or representatives engaged by Rubbish Removal Brompton to deliver the Service.

2. Scope of Services

Rubbish Removal Brompton provides on-demand rubbish removal, waste collection and related clearance services for domestic and commercial customers. Services may include collection from inside or outside a property, loading into a vehicle, transportation and lawful disposal at licensed facilities.

The exact scope of the Service to be provided will be agreed at the time of booking or during an on-site assessment. Any quotation is based on the information supplied by the Customer, including the type and volume of waste, access conditions and any special requirements disclosed in advance.

We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, unlawful to transport or dispose of, or beyond the capability or safety limits of our operatives or equipment.

3. Booking Process

Bookings can be made by telephone, email or other communication channels we may make available from time to time. When placing a booking, the Customer must provide accurate and complete information, including:

Contact details for the person responsible on the day of collection.

A description of the waste to be removed, including its approximate volume, weight and any unusual items.

Details of access, parking and any potential restrictions that may affect the Service.

Preferred dates and times for the collection.

Any quotation given over the phone or by email before attendance is an estimate only and is subject to confirmation upon arrival at the property when our operatives can assess the waste and access in person. We will confirm the final price with the Customer before commencing the Service.

4. Estimates, Quotes and Pricing

Our pricing is typically based on the volume and type of waste, measured by the space it occupies in our vehicle, and may also take into account weight, labour time, loading conditions, access difficulties and disposal fees.

Any estimate given prior to arrival is not binding and may change if:

The waste is significantly different in type, volume or weight from what was described at booking.

Access is more difficult than reasonably anticipated, including stair carries, long carries or obstructions.

Additional services are requested that were not included in the original estimate, such as dismantling, packing or extra loading.

Before starting work, our operatives will confirm the final price with the Customer. If the Customer does not accept the revised price, we will not be obliged to provide the Service and no charge will be made, other than any applicable call-out fee if this was specified at booking.

5. Access, Parking and Customer Obligations

The Customer is responsible for ensuring that adequate access and parking are available for our vehicles and operatives at the time of the Service. This includes, where necessary, arranging permits, visitor parking, loading bay access or similar permissions.

If we are unable to carry out the Service due to lack of access, unsafe conditions or absence of an authorised person to grant entry where required, we may cancel the visit and apply a reasonable missed appointment or call-out charge.

The Customer must ensure that the waste is clearly identified and separated from items that are to be retained. Our operatives are not responsible for identifying which items are to be removed beyond what the Customer clearly designates. We accept no liability for the accidental removal of items that were not clearly separated or identified as not for disposal.

6. Payments and Charges

Payment is due in full upon completion of the Service, unless alternative arrangements have been agreed in writing in advance. We generally accept payment by card, bank transfer, or other methods notified to the Customer when booking.

For commercial customers or regular contracts, we may agree to issue invoices payable within a specified period. Late payment may result in the suspension of further services and the application of interest or charges in line with applicable UK legislation governing late payment of commercial debts.

All prices quoted are exclusive of any applicable taxes unless stated otherwise. Where value added tax or other taxes are chargeable, they will be added to the invoice at the prevailing rate.

If payment is not received as required, we reserve the right to pursue recovery of any outstanding amounts, including reasonable costs incurred in debt collection, legal fees and enforcement expenses.

7. Cancellations, Rescheduling and Missed Appointments

The Customer may cancel or reschedule a booking by contacting us as soon as reasonably possible. We may apply the following rules:

If cancellation or rescheduling is requested more than 24 hours before the agreed arrival window, no cancellation fee will usually apply.

If cancellation or rescheduling is requested within 24 hours of the agreed arrival window, we may charge a reasonable cancellation fee to cover costs incurred.

If our operatives attend the property and are unable to complete the Service due to lack of access, inability to gain entry, absence of the Customer where access is required, unsafe conditions or inaccurate information provided, we may charge a call-out fee or a proportion of the quoted service charge.

We will use reasonable efforts to attend at the agreed time, but any arrival times are estimates only and may be affected by traffic, operational issues or weather conditions. We will not be liable for any indirect losses, such as loss of earnings, caused by delay or rescheduling, but we will keep the Customer informed and arrange a revised time where necessary.

8. Waste Types and Prohibited Materials

We operate in accordance with applicable UK waste management regulations and duty of care requirements. The Customer agrees to disclose fully the nature of the waste to be removed and warrants that no prohibited or unlawful items are included.

We do not normally collect hazardous or specialist waste such as:

Asbestos or materials suspected of containing asbestos.

Chemicals, solvents, oils, fuels or clinical waste.

Pressurised containers, gas bottles or certain batteries.

Medical or biological waste.

Any other items which are restricted or require a specific licence or specialist contractor for removal and disposal.

If such items are discovered during the Service, we may refuse to remove them, adjust the quotation, or terminate the Service immediately. Any additional costs incurred due to the Customer’s failure to declare hazardous or restricted waste, including regulatory penalties or specialist disposal costs, may be charged to the Customer.

9. Disposal and Environmental Compliance

Rubbish Removal Brompton is committed to responsible waste management. All waste collected is taken to appropriately licensed facilities for sorting, recycling, recovery or disposal in accordance with applicable UK laws and regulations.

Title in the waste transfers to us once it is loaded into our vehicle, unless otherwise agreed in writing. We may separate and allocate items for recycling, reuse or disposal at our discretion, in line with legal and environmental requirements.

We will issue documentation or receipts confirming that waste has been collected and transferred, where required by law or upon reasonable request.

10. Customer Representations and Warranties

The Customer represents and warrants that:

They are the owner of the waste or have the authority of the owner to arrange for its removal and disposal.

The waste does not include hazardous or prohibited materials except where previously disclosed and agreed.

All information provided for the purpose of booking and pricing the Service is accurate and complete.

The removal of the waste by us will not breach any applicable law, tenancy agreement, lease, restrictions or the rights of any third party.

The Customer agrees to indemnify and hold us harmless against any claims, costs or liabilities arising from breach of these warranties.

11. Liability and Limitations

We will exercise reasonable skill and care in providing the Service. However, our liability to the Customer is limited as follows:

We will not be liable for any indirect, consequential or economic loss, including loss of profit, revenue, business or opportunity, arising out of or in connection with the Service.

We will not be liable for damage to driveways, surfaces or access routes where the Customer has requested that our vehicles or operatives access areas not generally designed for heavy vehicles or equipment, or where reasonable care has been taken by our operatives.

We will not be liable for any damage caused by inherent defects, weaknesses or pre-existing conditions of the property, fixtures or items, including where such defects were not apparent at the time of the Service.

Our total liability for any claim arising out of or in connection with the Service shall not exceed the amount paid or payable by the Customer for the specific Service during which the event giving rise to the claim occurred, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.

12. Insurance

We maintain appropriate insurance cover for our rubbish removal operations, including public liability insurance, in line with industry practice. Details of our insurance cover can be made available to customers on request.

13. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Service, they should notify us as soon as possible, providing details of the issue and any supporting information. We will investigate the matter and seek to resolve it in a fair and timely manner.

Where a complaint relates to damage or loss, the Customer must notify us within a reasonable period after becoming aware of the issue and allow us an opportunity to inspect or assess the alleged damage before any remedial work or disposal is carried out.

14. Data Protection and Privacy

We collect and process personal information required to manage bookings, provide the Service, issue invoices and comply with legal obligations. Personal data will be handled in accordance with applicable UK data protection laws.

Customer details will not be sold to third parties. We may share information with trusted partners or service providers where necessary for the delivery of the Service, for payment processing, or where required by law or regulatory authorities.

15. Amendments to Terms

We may amend these Terms and Conditions from time to time to reflect changes in the law, industry standards or our business practices. The version in force at the time of booking will apply to that particular Service. Updated terms may be made available on request or displayed on our website where applicable.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish removal and waste collection services.

17. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between Rubbish Removal Brompton and the Customer in relation to the Service and supersede any prior discussions, correspondence or understandings relating to the subject matter.

By placing a booking or permitting our operatives to commence work, the Customer confirms that they have read, understood and agreed to these Terms and Conditions as the basis for all rubbish removal and waste collection services provided by Rubbish Removal Brompton.
